CGAMP Workshop on Personal Laws, March 8, 2009

The Committee on Gender Awareness and Mainstreaming in PRIA (CGAMP) organised a workshop on personal laws for all the head office staff members on March 8, 2009. The session was conducted by a Delhi based CSO called the Multiple Action Research Group (MARG), whose work on legal literacy is well known in the development sector.

For the purpose of understanding the theme better, all participants were divided into smaller groups and were provided with case studies to discuss and understand different perspectives related to personal laws. For instance, one group was given a case involving an adult couple that cannot get married because they belong to different castes. They decide to run away and get married; following which the girl’s family registers a complaint against the boy’s father and brother. The group was asked to think over questions like what advice would they give the couple, what should the police action be and others.

After all groups made their presentations, various components of personal laws were discussed. The second half of the four-hour workshop comprised an informative session on the Special Marriage Act (1954), Hindu Marriage Act (1955), Indian Christian Marriage Act (1872), Muslim Personal Law (1937), Divorce Act (1969), Dissolution of Muslim Marriage Act and the Arya Samaj Marriage Act, along with their comparative analysis.

The workshop ended with the participants being informed about the marriage registration process and a lively discussion on various aspects of marriage, divorce, issue of custody of children in the event of a divorce and others.
